  • Conflict of duties-the potential issues arising from staff and colleague expectations and assumptions around in house lawyer’s role. Particularly when does the duty to inform and advise the client arise, should staff reveal issues that should be reported to the client but may incriminate the staff member themselves.

  • Duty to not assist the client to mislead any third parties including reports that go to regulators.

  • Maintaining independence and objectivity when advising in matters that may impact on the in-house counsel’s own personal position or ethical obligations.

  • Managing external lawyers.
